123. There has been a decrease in 2010 in the number of children killed (11) compared to 2009 (24), but the trend of injured children increased in 2010 (360) compared to 2009 (271 excluding why are we excluding Cast Lead? It seems that injuries indeed decrease overall injuries occurred during operation Cast Lead) .Of the 360 children injured (342 boy and 18 girls), 58 children were under the age of 12; 83 percent of the injuries occurred in the West Bank, including East Jerusalem, and 17 percent in Gaza; 302 children were injured by the Israeli security forces, 40 by Israeli settlers, 11 by unexploded ordnance, and 2 by unidentified perpetrators. In addition, five children have been injured by mishandling weapons and explosives, including one incident allegedly involving Hamas militants, related to inter-factional fighting by Palestinian armed groups. As providing evidence would imply security risks for the communities, such incidents tend to be underreported in this number is assumed to be higher in both Gaza in the West Bank. No Israeli children were killed but two were injured, including one as a result of a rocket attack on Ashkelon from the Gaza Strip on 21 December 2010 launched by an unidentified Palestinian armed group no claim made?

124. There are serious concerns regarding the increasing number of civilians, Including children shot and injured in the Gaza buffer zone (covering the area between zero and 300 meters from the Gaza fence. The zone is not physically delimited, and is known to be an area where militants continue to operate and often clash with the Israeli security forces shootings can occur given the Israeli Army statement of May 2009 that any individual entering the zone would be endangering their life). However, Palestinians continue to collect gravel and scrap metal in abandoned settlements and industrial zones near the fence, which they later sell to support their families. 40 boys and 4 girls were injured by Israeli fire in such circumstances .further, in additional 26 boys, some as young as 13 years, were shot (are we implying that they were deliberately shot?) While collecting gravel within 800 meters of the fence .In 69 percent of the cases where sworn affidavits (no independent verification of the information? If not independent, what about Israelis explanations? Were sought? ) were taken (16 out of 23 cases), the children were outside of the 300-meter zone.19 children stated that they were shot in the leg, two in the arm and one child was shot in the head . the repeated shooting (deliberate ?) children by Israeli soldiers in and out of the Buffer Zone is a violation of applicable international law .

125. For the third consecutive year, the trend (three cases below-does it represent a trend?) of using Palestinian children as human shields (what is the definition of human shield ? does it include house searches?) by Israeli security forces continued in 2010, with three new cases documented in three separate incidents in the West Bank. A 16 year old girl and a 13 year old boy were used as human shields during house searches in two separate incidents in Nablus, and a 14 year old boy was forced to walk in front of Israeli soldiers as a shield while stones were being thrown at them during clashes in Hebron. For the first time, on 11 March 2010, two soldiers were charged with using a boy as a human shield (did the Court referred to the case as “human shield”? if not, we should not misrepresent Court ruling) during “Operation Cast Lead” in 2009 and were convicted by an Israeli military court on 3 October 2010 for “inappropriate behavior” and “overstepping authority”. They were demoted from the rank of staff sergeant to sergeant and given three-month suspended prison sentences. According the international law, the use of children as human shields is a war crime and is illegal according to Israeli High Court of Justice? The gravity in the systematic (do three cases constitute systematic pattern?) nature of the violations committed have not yet been reflected by appropriate measures taken by the Israeli forces to prevent such use of children in conflict.

126. As of December 2010, 213 Palestinian children between the ages of 12 – 17 years were in Israeli detention, including one girl. This represents a 30 percent reduction from December 2009 (305 children).two children were still held without charge (what are the charges brought against the other 211? For example…) I believe that the detention of children is not illegal per se if they are involved in criminal activities. Obviously the situation in Israel oPt is different and we need to take into account the political situation. Nevertheless it remains important to explain that probably most of these arrests were related to violent protest or even worse in some cases to terrorist attacks. Or trial in 2010, including one boy having been detained for over 10 months. Cases have been documented relating to the arrest of young children in Silwan, a neighborhood of East Jerusalem, with a sharp increase in the last quarter of 2010. According to Israeli police figures, 1,267 criminal files were opened against children accused of throwing stones in East Jerusalem between October 2009 and October 2010. Ill treatment is dealt with in the next Para There are also increasing reports of violence and mistreatment of children by Israeli soldiers during patrols in Silwan, as well as during the arrest, transfer to detention and interrogations of children from East Jerusalem.

127. In 2010, 90 cases of ill-treatment it is very serious accusation that does not seem to be corroborated by independent evidence – I think that the report should make such accusation without solid and independent proofs. Moreover, the word torture is barely mention in other parts of the report where the situation of human right and children seem to be much worse and acts tantamount to torture of Palestinian children in Israeli detention were documented , including through the sworn affidavits of children. Twenty-four children were below the age of 15, including two 10-year olds and one 7-year old. In more than 75 cases the excessive or extended use of hand-ties and blindfolds were reported, 62 children reported being beaten, 35 children reported position abuse and 16 children were kept in solitary confinement. In three cases, children reported (do we have independent evidence? Medical? UN? or Israeli explanation) the use of electric shocks on their bodies and four reported being threatened with electric shocks in the course of their interrogation, which resulted in confessions made under duress .Of particular concern, there was an increase in documented cases (do we have independent evidence etc. for this extremely serious accusation ?) Of sexual violence, with 14 cases (13 boys and 1 girl) in 2010 compared to 9 cases (8 boys and 1 girl) in 2009. The cases involved sexual assault and threats of sexual violence , including the use of electrical cables on genitals. The high number of violations reported and documented suggests that ill treatment of children and used systematically in the Israeli military court system(or detention facilities?).despite complaints made to the Ministry of Justice, no judicial investigations of any of those cases has been undertaken .

128. One case of ill- treatment of a Palestinian boy by the Palestinian Preventative Security Forces (PPSF) was also documented. The case refers to an incident involving alleged association with Hamas. The boy was threatened and beaten for the confession. He was released after having been detained for 8 days in solitary confinement, for eight days denied access to a lawyer and taken before a judge. What is the situation of detention facilities in Gaza? No ill- treatment there? If there are no info, we probably should say so and also explain why we do not have them.

129. There was an increase attacks on schools and education facilities by Israeli security forces and settlers in 2010 (20 cases), compared to 2009 (9 cases). The attacks resulted in damage to schools or interrupted education, placing the safety of the children in Gaza and the West Bank at risk. The majority of cases involved the presence of Israeli security forces within school compounds as part of raids, forceful entry, and search and arrest operations, including the use of tear gas on students. There were also three air strikes and shelling incidents by Israeli security forces which resulted in heavy and partial damage to four schools in Gaza, although schools were not directly targeted. There have also been an increasing number of incidents in which Palestinian students have been prevented from accessing schools and their safety compromised. Thirty-six such incidents were documented in the West Bank in 2010, purportedly involving security measures such as road closures and searches, harassment or assaults at checkpoints by Israeli authorities and settlers. In other cases, children were exposed to settler violence as Israeli authorities did not provide military escorts to protect children who pass near historically violent settlements and outposts in the West Bank, particularly Hebron. In this regard, the Israeli authorities have not yet responded to the request in February 2009 of my Special Representative on Children and Armed Conflict to investigate the 2008 attack against School children by Israeli settlers of children on their way to the Al-Tuwani School outside Hebron. In addition, the blockade on the Gaza Strip is also having a devastating impact on availability, accessibility and quality of education in Gaza. UNRWA was unable to deliver education to an estimated 40000 Palestinian refugee children owing to a shortage of school space as a result on the blockade and related ban (the GOI is allowing construction material for UN projects and the ban has been partially lifted- progress in that sense are reported on a monthly basis to the Security Council) on construction materials to rebuild schools destroyed or damaged during “Operation Cast Lead”. UNRWA is building 20 new schools ets. Some progress is taking place and it should be reported on In 2010, Palestinian armed groups were responsible for eight incidents related to access to education, including four attacks on schools in Israel, Gaza and the West Bank. There are very detailed information about arson attacks against UNRWA schools in Gaza. Why are those attacks not reported?.

130. On 20 June 2010, the Israeli Security Cabinet declared the easing of the Gaza blockade, particularly pertaining to civilian goods and humanitarian access. While this has resulted in some improvement in the entry of construction materials, it amounts to only a fraction of what is needed to meet the humanitarian needs (this sentence is questionable- the HC and the UN in general did not characterize the situation in Gaza as a humanitarian crisis even during “Operation Cast Lead”, let alone now) of the population of Gaza. Gaza’s health-care system also suffers from a severe lack of adequate equipment and instruments. As a result, patients must seek treatment outside of Gaza. From January to November 2010, while 3,546 out of 3,851 (92 per cent) applications for children who sought medical assistance outside of Gaza were approved, 294 applications were delayed and 11 were denied. Both the delays and denials in processing applications can be life-threatening for child patients who are waiting for urgent medical treatment. Four children, all under the age of 3 years, died while waiting (for how long?) for the appropriate permits to travel outside of Gaza in 2010.

131. Forced displacement continues to affect the lives of hundreds of Palestinian families every year. More than 431 Palestinian structures were demolished in 2010 in East Jerusalem and Area C of the West Bank, including 133 residential structures, leaving at least 594 people, of which 299 children, homeless. More than 2500 people including 1101 children were affected in other ways, including loss of livelihood due to the demolitions. More than 714 demolition eviction or stop-work-orders were issued or renewed against residential and non- residential structures in the West Bank, in Area C, and East Jerusalem, affecting a total of 2975 people, including 1180 children.
